GENERAL TERMS AND CONDITIONS
1. Scope of Application
The website www.kidywolf.com (the “Website”) is operated by NESPART SRL, with its registered office at Drève Richelle 161 K - box 25, 1410 Waterloo, and registered with the Crossroad Bank for Enterprises under number 0721.600.024 (“NESPART SRL”).
These General Terms and Conditions manage the use of the Website and apply to all orders placed via the Website. We invite you to read them carefully before placing any order. By placing an order on our Website, you acknowledge that you have read and are bound by these General Terms and Conditions.
Any reference to the “customer” or “you” refers to the person or persons purchasing or agreeing to purchase goods on the Website.
NESPART SRL reserves the right to modify these Terms and Conditions at any time. In such cases, these modifications will apply only to future orders of products.
2. Prices
All item prices are displayed in euros and include VAT at the current rate, excluding shipping costs, unless clearly and specifically stated otherwise. Shipping costs will be indicated separately, depending on the shipping method chosen by the customer. Offers and prices provided by NESPART SRL are valid as long as they are displayed and subject to supplies availability. All prices are subject to change without prior notice. In such cases, the applicable prices are those in effect at the time of the order.
3. Ordering and Payment Process
The ordering process on the Website proceeds as follows:
You select the items you wish to order and add them to your cart. The customer is free to modify their cart, remove an initially selected item, change the quantities ordered, or add an item. Once the customer has finished selecting items and wishes to confirm the contents of their cart, the customer must then click the “Proceed to Checkout” button.
To proceed with your order, you must log in or create an account on the Website’s e-shop. Some contact details will be requested to process your order. The customer is responsible for verifying the accuracy of the information provided when placing an order, particularly their email address. Any mistake, omission, or inaccuracy in the email address provided is the customer’s sole responsibility. In the event of an incorrect email address, NESPART SRL cannot be held responsible for the non-receipt of communications related to the order (order confirmation, tracking information, notifications, delivery of electronic documents, etc.). Any costs incurred for the resending of information or documents resulting from a mistake attributable to the customer may be billed to the customer.
The customer must confirm the delivery method and provide the information necessary for the proper delivery of the order. You will be informed, prior to the final confirmation of your order, of all applicable delivery charges for your order (excluding customs duties), if any.
Promotional codes and special offers must be entered into and confirmed by the customer before the order is finalized and payment is made. Once the order has been confirmed and paid for, no promotional codes or special offers can be applied retroactively. Customers are advised to verify, before confirming their order, that any desired discounts or promotional offers have been applied.
The customer must verify the accuracy of their selection before confirming their order. The order details are then summarized again for a final review and to correct any mistakes. After expressly accepting these General Terms and Conditions and clicking the “PAY NOW” button, the customer places a binding order for the item(s) in their cart and accepts the price.
The customer can pay for their purchases using the following payment methods:
- by credit card (Visa, MasterCard, Bancontact);
- via the secure payment systems Google Pay and Apple Pay;
Payment shall not be considered complete until NESPART SRL has received the full amount owed by the customer. If the transaction is paid for with a credit or debit card, your order is not complete and the contract between us is not final until we receive authorization from the card issuer. We cannot be held responsible for delays in delivery and/or non-delivery of your order resulting from the card issuer’s refusal to process your payment. Orders not accompanied by valid payment in the cardholder’s name will not be accepted or processed.
An order confirmation is sent to the customer at the email address provided, including the order number, the total order amount, and information regarding shipping costs and delivery details. The order confirmation does not constitute our acceptance of your order: it merely confirms that we have received your order.
An email confirming shipment of the products, including the delivery tracking link, will then be sent to you. Delivery of the products constitutes our acceptance of your order. Delivery will only be made after receipt of payment for the order.
In any case, NESPART SRL reserves the right to refuse any order or delivery in the following cases:
- the products are unavailable or out of stock;
- the products are incorrectly or inaccurately presented in the online store;
- there are serious doubts regarding abuse of rights or bad faith on the part of the customer;
- a force majeure event occurs.
In the event that we do not fulfill the order, the customer will be notified as soon as possible.
If, despite NESPART SRL’s best efforts, an item turns out to be out of stock, we will notify you by email as soon as possible and, depending on the situation, offer you partial delivery of the order, replacement of the unavailable product with an equivalent product, or complete cancellation of your order. In the event of cancellation, any amount already paid will be refunded in full within thirty (30) calendar days.
Due to the automated and near-immediate processing of orders by our systems and our logistics provider, no changes (address, products, quantities, pickup location, etc.) or cancellations can be guaranteed after the order has been confirmed. Customers are therefore advised to carefully review the contents of their order before final confirmation.
To place an order, you must be at least 18 years old. If you are under 18, please have your parents or legal guardian place the order. We reserve the right to refuse any order that we determine was placed by a minor.
4. Delivery
Items ordered on our Website will be delivered to you as soon as possible under payment receipt, either to the address you provided during the ordering process or to the pickup location of your choice.
If the address you provided is incorrect, you will be held responsible, and this may result in additional charges. When placing an order, the customer is asked to select a pickup location from the available options after payment. If the customer fails to select or confirm a pickup location, we reserve the right to designate one located near the delivery address provided at the time of the order. The pickup location thus selected will be deemed accepted by the customer. We shall not be held liable for this designation provided that the chosen location is reasonably situated in relation to the address provided by the customer.
For home deliveries, if you are absent at the time of delivery, the carrier may leave the package at a pickup location near the delivery address and invite you to pick it up within a certain timeframe. Packages not claimed by the end of this period will be returned to us. We accept no liability for delivery delays caused by the recipient’s absence or failure to collect the package within the specified timeframe.
Deliveries are entrusted to a third-party carrier selected by NESPART SRL:
- the carrier may, if necessary, use a subcontractor to ensure delivery, which the customer expressly accepts;
- the delivery times provided at the time of ordering are for informational purposes only, unless otherwise stated. We will do our best to ship your order as quickly as possible. During peak periods (such as the end of the year, promotional periods, or exceptional circumstances), additional delays may occur. Under no circumstances will any delay give rise to compensation;
- for deliveries outside the European Union, any customs duties, local import taxes, or customs clearance fees shall be the sole responsibility of the customer. It is the customer’s responsibility to inquire with the relevant authorities in their country.
We decline all responsibility for any indirect damage caused by late delivery or failure to deliver. If the delivery time exceeds 30 days, you have the right to cancel your order at no cost.
The transfer of risk of loss or damage to the products occurs at the moment the customer, or a third party designated by the customer other than the carrier, takes physical possession of the products. Consequently, the products are transported at our risk until they are actually delivered to the customer.
In the event that the products are damaged during transport or do not correspond to the items listed on the delivery note or do not correspond to the items you ordered, you are required to report this as soon as possible and in any case within 3 days. To do so, please contact us atsav@kidywolf.com.
5. Right of withdrawal
We want you to be completely satisfied with every purchase made on the NESPART SRL Website, and we do our utmost to always provide you with quality products and service.
As a consumer, you have the right to withdraw from the purchase and return the ordered items at your own expense without giving a reason within 14 calendar days. This period begins the day after the order is delivered. You may exercise this right by sending an email to sav@kidywolf.com
In the event of a full return for a refund, we will refund the total amount of the order as well as the shipping costs (unless you specifically chose a shipping method other than the least expensive standard shipping option offered by NESPART SRL when placing your order). In the case of a partial return for a refund, the shipping costs remain due; we will refund only the amount of the returned items. Products that are part of a bundle, a set, or a promotional offer contingent on the purchase of multiple products must be returned in their entirety to qualify for a refund. The refund will be processed within 14 days of receiving the returned items and will be issued via the same payment method used by the customer for the original transaction.
In any case, items must be returned to us in their original condition and in their original packaging within 14 days of the date of your return request. The return must be shipped in packaging suitable for shipping. The original packaging provided with the product does not constitute shipping packaging.
You are responsible for the items until they reach NESPART SRL, and we will not refund returned items that have been lost. You must keep proof of shipment, which may be required to process your request. Packages must be shipped directly to the address we have provided. Any shipment sent to a pickup point or other unauthorized location without notifying us may be returned to the sender without recourse.
In the event of minor damage to the items resulting from handling other than that necessary to establish their nature, characteristics, or proper functioning, the refund will be reduced accordingly.
The right of withdrawal does not apply:
- to items that are damaged, dirty, or worn;
- to items that are incomplete or not in their original packaging;
- to sealed items that cannot be returned for health or hygiene reasons and that have been unsealed by the customer after delivery;
- to items that have been personalized or custom-made at the customer’s request.
Items returned in this condition will remain at your disposal at NESPART SRL and will not be refunded.
6. Products
Unless otherwise expressly stated, products are sold individually. NESPART SRL strives to describe products as accurately as possible and to provide sufficient precise information to allow the customer to assess their essential characteristics before placing an order. Photographs, illustrations, and visuals are provided for informational purposes only and are intended to depict the products offered as faithfully as possible. However, minor variations may exist, particularly due to screen display settings or slight product updates. In the event of an obvious mistake in a description or illustration, we are not forced to provide you with an item matching the illustration, as the photos are non-binding.
NESPART SRL guarantees that the product is in perfect condition upon delivery and conforms to the manufacturer’s specifications. The product must be used in accordance with the manufacturer’s instructions, as described in the product description. You must ensure that you use the product in accordance with these instructions.
We do our best to deliver products to you in perfect condition. However, if you report that the product is defective, you agree to keep the product in its current condition so that we can examine it within a reasonable timeframe. We may request your assistance and certain information regarding the product, including details on how the product is believed to be damaged or defective, as well as the sending of the completed delivery note and other necessary information, in order to provide a prompt resolution for the defective product.
In the event that we determine that the product has been misused, abused, or neglected—including accidents, damage resulting from an attempt to modify or repair it, damage due to normal wear and tear, or any other improper use contrary to the manufacturer’s recommendations—and this occurred after delivery, NESPART SRL reserves the right not to replace or refund the product.
7. Conformity and Warranty
We guarantee that the items sold through the Website comply with your order and meet the reasonable expectations you may have, given the product specifications. We also guarantee that these items comply with all applicable laws in effect at the time of your order.
We also apply the minimum legal warranty period of two years if the item does not conform to the order placed. This warranty means that any item with defects or flaws will be repaired or replaced free of charge for up to two years after delivery. Batteries, on the other hand, are covered by the statutory warranty period of 6 months. Slight variations or minor visual defects that do not affect the functionality or safety of the product do not constitute a lack of conformity under applicable legal provisions.
To the extent possible and reasonable, you may choose between repairing or replacement of the defective item. You are entitled to request a price reduction or termination of the sales contract only if repair or replacement is excessive or impossible, or if it cannot be carried out within a reasonable timeframe.
Any defect that becomes apparent within 6 months of delivery is presumed to have existed prior to delivery, unless we can prove otherwise. After 6 months, it is up to the customer to prove that the defect existed prior to delivery.
To facilitate the return of the defective item, we recommend that you send us pictures of the item, the item’s serial number, and a video explaining the issue via email to sav@kidywolf.com, including the order number, and keep the tracking number provided.
When the product was purchased from an authorized retailer, the customer is asked to contact that retailer directly, as the retailer remains the contractual point of contact for any warranty or after-sales service requests, unless otherwise specified.
If the product was purchased on our Website and given as a gift, any return request must be accompanied by proof of purchase.
8. Gift Cards
KIDYWOLF gift cards are available for purchase on the Website www.kidywolf.com and are valid for 12 months from the date of purchase. They may be used exclusively on the Website to purchase products, in one or more transactions, up to the amount credited to the card. If the balance is insufficient, the recipient may complete the purchase using another accepted payment method. Gift cards may not be exchanged, resold, or converted into cash. After the 12-month validity period, any unused or partially used gift card will expire permanently, with no possibility of refund or extension. In accordance with applicable regulations, the purchase of a gift card is final and is not subject to the right of withdrawal or refund.
8. Force Majeure Event
We cannot be held liable for any failure to fulfill our obligations caused by or resulting from labor disputes or any other circumstances beyond the company’s reasonable control, such as acts of God, riots, civil unrest, floods, fires, strikes, lockouts, transportation difficulties, or legislation.
9. Pricing and Printing Mistakes
The prices and specifications of the products listed on the Website are verified and updated to the best of our ability. We undertake to use our best efforts to correct any mistakes or omissions that may be discovered. Except in cases of gross negligence or willful misconduct, we cannot be held liable for any mistakes or omissions. We reserve the right to modify our prices and specifications at any time without prior notice.
10. Ownership of Goods
All items delivered to the customer remain the property of NESPART SRL until full and final payment of all amounts due for such goods.
11. Complaints
Any complaints or other inquiries may be sent to our customer service department at sav@kidywolf.com. We will make every effort to address your complaint within 5 business days of receipt. If we are unable to resolve your complaint immediately, we will notify you of the estimated time required to resolve the issue and will keep you informed of any progress.

14. Intellectual Property
Our Website, our logos, texts, pictures, names, and, generally speaking, all of our communications are protected by our intellectual property rights, those of our subcontractors, or other rights holders. It is prohibited to use and/or make modifications to the intellectual property rights described in this article. It is also prohibited to copy or reproduce designs, pictures, text, color combinations of logos, etc., without our prior and express written authorization.
15. Protection of Personal Data
NESPART SRL collects the customer’s personal data necessary for processing the order. When processing the customer’s personal data, NESPART SRL complies with applicable legal provisions. You can find further information on how we process your personal data and on your rights in our Privacy Policy.
16.Severability
If one or more provisions of these General Terms and Conditions are considered invalid or unenforceable under any law, regulation, or as a result of a final decision by a competent court, the other provisions shall remain unaffected and fully in force. In such a case, the parties agree to replace any unenforceable or invalid provision with a new, valid provision that best achieves the objectives of the invalidated provision.
17. Governing Law and Jurisdiction
These General Terms and Conditions, as well as the contractual relationship between the parties, are governed by Belgian law. In the event of a dispute, the courts of the judicial district of Brussels shall have jurisdiction or, where applicable, the judicial district in which the consumer is domiciled.
