1. Terms and conditions applicable to the website www.kidywolf.com of NESPART srl.

These terms and conditions are applicable to all transactions made online with NESPART srl. All contracts are governed and interpreted according to Belgian law, and any dispute between us is the exclusive jurisdiction of the Belgian courts. Nothing in these terms and conditions shall be deemed to affect your statutory rights.

By using this site, you agree to these terms and conditions, and all transactions with NESPART srl are governed by these same terms and conditions.

Any reference to the “company” or “us” means a reference to NESPART srl. Any reference to the “customer” refers to the person or persons who purchase or agree to purchase goods from the company. Any reference to the website includes a reference to all URLs belonging to NESPART srl.

2. Prices

All prices are displayed in Euros and include VAT at the current rate, unless otherwise clearly and precisely indicated. The offers and prices made by NESPART srl are valid as long as they are displayed and within the limits of available stocks. All prices are subject to change without prior notice.

3. Ordering process and payment

The ordering process on the NESPART srl website (www.kidywolf.com) is as follows:

You select the items you wish to order and add them to your basket. On the shopping cart page, you can then click on the “Checkout” button. In order to proceed with your order, you must log in or create an account on the e-shop site. You will be asked to provide certain details in order to process your order.

You will be able to choose your delivery method from those offered by GLS/Mondial Relay by filling in the required information. You will be informed, before the final validation of your order, of all the delivery charges applicable to your order, if any. Your order will only be valid once you have provided this information, read and accepted the general terms and conditions of sale and successfully paid for your order by clicking on the order button with the word “Pay”, via the payment system of our provider STRIP. The payment process is completely secure. The order can be modified at any time before the final validation.

Once the payment has been made, you can print the details of your order and follow its status on your personal account. An acknowledgement of receipt will be sent to you automatically by email, including the details of your order. The acknowledgement of receipt does not represent an acceptance of your order on our part: the acknowledgement of receipt only confirms that we have received your order.

An e-mail confirming the dispatch of the products, including the delivery tracking link, will then be sent to you. The delivery of the products is considered as acceptance of your order by us. Delivery will only be made once payment for the order has been received.

We reserve the right to refuse your order in the following circumstances

– the products are unavailable or out of stock;

– the products are misrepresented or invalid in the eshop;

– there are serious doubts about abuse of rights or bad faith on the part of the customer;

– force majeure occurs.

In the event that we do not execute the order, the customer will be informed as soon as possible.

If you pay for the transaction with a credit or debit card, your order is not complete and the contract between us is not final until we have obtained the approval of the card issuer. We accept Visa, MasterCard and Maestro (Bancontact) from most major European banks. We cannot be held responsible for delays in delivery and/or non-delivery of your order due to the refusal of your card issuer to make your payment. Orders that are not accompanied by a valid payment in the name of the cardholder will not be accepted or processed.

In the case of payment by bank transfer, your order is not complete and the contract between us is not final until our account is credited with your payment.

In order to place an order, you must be at least 18 years old. If you are not 18 years of age, please have your parents or legal guardian place the order. We have the right to refuse any order that we determine to be placed by a minor.

4. Delivery

All goods and services are delivered to the address you provide when ordering. If the address you provide is incorrect, you will be responsible for this and may incur additional costs.

During the ordering process, you will be informed of the possible shipping costs. These are calculated definitively at the end of the order process, before the “Proceed to payment” stage and before the payment is processed by our service provider STRIP.

The risks will be transferred to you when the product is actually delivered to the address you have indicated. From that moment on, we decline all responsibility in case of loss or destruction of the product.

The products are delivered, as far as possible, within 48 to 96 hours in Western Europe after the validation of the order. In the event that we are unable to deliver within this timeframe, we will inform you as soon as possible. Under no circumstances will any delay give rise to compensation. In the exceptional event that we are unable to deliver the order within 30 days of the order being confirmed, you may cancel the sales contract by

contacting our customer service. The ordered products will be refunded in full (including the shipping costs if you have paid for them) within 30 days.

You must ensure yourself that the products are suitable for your needs and meet your expectations. We do not guarantee that the products meet your individual requirements. The products are standard and have not been customised. If you have any complaints, you can contact our customer service department.

In the event that the products are damaged in transit or that the products delivered differ from the products ordered, you are required to notify us as soon as possible and in any case within 3 days, by contacting our customer service department.

We cannot be held responsible for any indirect damage caused by late delivery or non-delivery by GLS/Mondial Relay. In this case, our liability is limited to the value of the items proven not to have been received by the customer.

Our shipments are always made at our risk. Therefore, you should not be concerned if goods are lost during shipment. However, if you return goods to us within 14 days of purchase because you do not wish to keep them, you are responsible for their transport.

If the goods delivered by us are damaged in transit, do not match the items on the delivery note or do not match the items you ordered, you must report this as soon as possible and in any event within 3 days, and return the goods to us within 14 calendar days of receipt. 5. Returns and exchanges

We want you to be completely satisfied with every purchase you make from the NESPART srl website, and we do our utmost to provide you with quality products and service at all times.

However, if you wish to return your purchase, we offer you a way to do so here:

Via DPD

In case of an online return via DPD, the return costs will be at your expense. You have the option of receiving a refund or returning the goods in exchange for an online coupon.

To make the return, you need to fill in the information on the return form and put the return form with the items in the parcel. The return form can be obtained on request at the following address

In the case of a complete return against reimbursement, we will reimburse the total amount of the order and the delivery costs.

In the case of a partial return against reimbursement, the delivery costs remain due, we will only reimburse the amount of the items returned. The refund will be made within 14 days of receipt of the returned items and will be made using the same payment method as the customer used for the original transaction.

If you wish to exchange an item, a coupon for the value of your item will be sent to you upon receipt of your return so that you can reorder. The coupon can be used on any purchase of at least the value of the coupon

In any case, items must be returned to us in their original condition, unworn, with their labels and in their original packaging, within 14 days of the delivery date.

6. Products

Unless otherwise stated, products are sold individually and are not always available. If one or more items are not available at the time of placing an order, we will unfortunately be unable to fulfil the order in full.

We always describe as fully and accurately as possible what we sell and how the ordering process will work. The description is always sufficiently detailed to enable you to assess it correctly. If we use illustrations, they are a true representation of the items offered. However, it is human nature to make mistakes, so if it becomes clear that we have made a mistake, we are not obliged to supply you with an item that corresponds to the illustration. The photos are non-contractual.

NESPART srl guarantees the intact condition of the product upon delivery and its conformity to the manufacturer’s information. The use of the product must follow the instructions published by the manufacturer, described in the product description. You must ensure that you use the product in accordance with these instructions.

We endeavour to deliver products to you in perfect condition. However, if you report that the product is defective, you agree to keep the product in its current condition so that we can examine it within a reasonable time. We may require your assistance and certain information about the product, including details of how the product is believed to be damaged or defective and the sending of the completed delivery note and other necessary information, in order to provide a prompt solution for the defective product.

In case we find that the product has been misused, abused or neglected, including accidents, damage resulting from attempted modification or repair, damage due to regular normal wear and tear and any other action inappropriate to its use as recommended by the manufacturer, after delivery, NESPART srl reserves the right not to replace or refund the product.

7. Conformity and guarantee

We guarantee that our goods conform to your order and that they meet the normal expectations you may have, taking into account the product specifications. We also guarantee that our goods comply with all applicable laws at the time of your order.

In relation to the delivery of goods, we also apply the statutory minimum warranty period of two years if the goods do not conform to the order placed. This guarantee means that any goods that are defective or faulty will be repaired or replaced free of charge up to 2 years after delivery.

Batteries are guaranteed for the statutory period of 6 months.

As far as is possible and reasonable, you have the choice between repair or replacement. You are only entitled to demand a reduction in price or rescission of the contract of sale if repair or replacement proves to be excessive or impossible or if it cannot be carried out within a reasonable period.

Any defect or fault that becomes apparent within 6 months of delivery shall be deemed to have existed prior to delivery, unless we are able to prove the contrary. After 6 months, it is up to you to prove that the defect existed before delivery.

8. Rules applicable to telesales

You have the right to cancel your order within 14 calendar days of the day following the date of delivery for any unused items purchased via the website in accordance with the Telesales Regulations for a refund. This does not apply to personalised items or items made to your own specifications.

To cancel an ordered item, you can send us an email stating your customer number and the order number (info@nespart.com). You must take care of the items, keep all original packaging and not use them. Goods must be returned to us within 14 days of your cancellation notice. Goods can be returned to our customer service department. Goods will be returned at your expense, unless the items are found to be faulty or incorrect, in which case we will refund your postage costs on receipt of the goods. Provided the goods are returned to us undamaged in their original packaging with all accessories, you will receive a refund within 30 days of your cancellation notice.

9. Force majeure

We shall not be liable for failure to fulfil our obligations caused by or resulting from industrial disputes or any other circumstances beyond the reasonable control of the company, such as acts of God, riots, civil commotion, floods, fires, strikes, lockouts, difficulty in obtaining transport or legislation. If any of these circumstances prevent the company from delivering all or part of the ordered items within a reasonable time, the customer’s liability is limited to the value of the items supplied and the associated delivery costs.

10. Content

Any information posted on our website(s) or other printed material by the company is not considered authoritative or certified as best practice and should only be considered as useful information complementary to other certified codes of practice. All information on our website is regularly updated.

11. Pricing and printing errors

Prices and specifications are checked to the best of our ability, and while every effort has been made to ensure their accuracy, no liability is accepted for errors and omissions. We reserve the right to change our prices and specifications without prior notice.

12. Ownership of goods

All items delivered to the customer remain the property of NESPART srl until final and full payment of all sums due for such goods.

13. Complaints

Any complaint, or compliment, can be sent to our customer service (info@nespart.com). We will endeavour to deal with your complaint within 5 working days of receipt. In the event that we are unable to resolve your complaint immediately, we will advise you of the likely time required to resolve the issue and keep you informed of any investigation.

16. Intellectual property

Our website, our logos, texts, photos, names and, in general, all our communication are protected by our intellectual property rights, those of our subcontractors or other right holders. It is forbidden to use and/or modify the intellectual property rights described in this article. It is therefore forbidden to copy or reproduce drawings, photos, texts, colour combinations of logos, etc. without our prior and express written permission.

17. Customer notice

These rules specify the conditions under which you may submit or use a customer review on our website. These rules supplement our website terms of use and privacy policy and apply to all users of our website.

By viewing and submitting content to our website, you agree to comply with all of the terms and conditions of these rules.

18. Right of Withdrawal

If you purchase products from us, you have 14 days from delivery to decide that you do not want to keep the products. In this case, you can return the order without having to pay a fine or justify your decision (the costs of returning the goods are at your expense). If you return your order or wish to withdraw from the contract within 14 days of placing your order, we will refund the full purchase price by the same method of payment you used. The direct costs of returning the goods are therefore at

your responsibility. We will inform you of the cost of returning the goods or, if it is not reasonably possible to determine this in advance, we will give you an estimate.

We have the right to wait until we have collected the goods or you have proved that you have returned them, whichever is the earlier, before refunding them.

For the first 14 days after delivery, we expect you to treat the order and packaging with care. If you wish to be able to return the goods in accordance with the procedure described above, you may only unpack or use them to the extent necessary to assess whether you wish to keep the goods. Returned goods may have been tried on, but not used. Wherever possible, returned goods should be in their original packaging and accompanied by all accessories supplied. They must be in their original condition and packaging, taking into account the instructions mentioned below. You can return the package by DPD.
